Overall Purpose

This role will provide primary legal support to the corporate marketing teams advising on a broad range of marketing, advertising, and brand protection matters for all of the company's lines of business and brands.

Essential Functions

  • Review and advise on marketing and promotional materials and campaigns across multiple formats (e.g., print, digital, social media, video, etc.) to ensure compliance with legal requirements, intellectual property (IP) and brand policies and guidelines.

  • Advise on marketing and advertising claims development and adequacy of substantiation for legal compliance.

  • Advise client groups on regulatory and compliance issues related to advertising, marketing and promotional activities including UDAAP, TCPA, CAN-SPAM and other relevant consumer protection laws and regulations.

  • Identify IP risks in connection with marketing activities and work with specialists in this area.

  • Support brand protection/enforcement efforts.

  • Stay abreast of relevant market, legal and regulatory developments affecting marketing, advertising and promotional practices.

  • Draft, review and negotiate a variety of contracts including marketing agreements, agency agreements, sponsorship agreements, influencer agreements and licensing agreements.

  • Develop role-based training and education programs for management and employees on marketing and advertising legal issues, social media compliance and relevant company policies.

  • Partner with the Risk team and other members of the Legal Department (e.g., Product Counsel, IP, Privacy, Data, etc.)

  • Comply with all security policies and procedures to ensure that the highest level of system and data confidentiality, integrity and availability is maintained.

Minimum Qualifications

  • Juris Doctorate from accredited law school; admission to one or more State bars.

  • 7+ years' relevant legal experience.

  • Experience advising on marketing related legal issues and transactions with a robust background in consumer financial services.

  • Experience in the area of digital/social marketing including contracting and licensing, intellectual property and regulatory compliance.

  • Strong experience in contract drafting, review and negotiation.

  • Ability to work independently but collaboratively in fast-paced and collegial team environment.

  • Ability to think practically and be solution-oriented.

  • Highly effective verbal and written communication and presentation skills with all levels of the organization.

  • Strong business acumen.

  • Proactive self-starter.

  • Unyielding commitment to highest professional ethics.

  • Background and drug screen.

Preferred Qualifications

  • Experience supporting public relations and communications teams.

  • Familiarity with antitrust laws.

Physical Requirements

Working conditions consist of a normal office environment. Work is primarily sedentary and requires extensive use of a computer and involves sitting for periods of approximately four hours. Work may require occasional standing, walking, kneeling, and reaching. Must be able to lift 10 pounds occasionally and/or negligible amount of force frequently. Requires visual acuity and dexterity to view, prepare, and manipulate documents and office equipment including personal computers. Requires the ability to communicate with internal and/or external customers. Employee must be able to perform essential functions and physical requirements of position with or without reasonable accommodation. The base pay scale for this position in:

Phoenix, AZ/ Chicago, IL in USD per year is: $200,000 - $230,000.

New York, NY/ San Francisco, CA in USD per year is: $230,000 - $260,000.
